The accused has no right to the application of a disposition that extinguishes the committed felony for elapsed time, even if favorable to him, in case the aforesaid disposition is incompatible with the EU’s Treaty. The application cannot be beseeched even by invoking constitutional guarantees, since a “right to impunity” constitutes an undermining of the very principle of legality. The reasonable length of the trial is different from the time-bar. The Taricco sentence of the ECJ brings to such conclusions, and in this direction also goes the Italian Supreme Court with sentences No. 2210/16 and 7914/16, though with different results.
L’imputato non ha diritto all’applicazione di una norma estintiva del reato per decorso del tempo, quantunque a lui favorevole, se dichiarata incompatibile con le norme del Trattato UE, perche´ non puo` accampare il “diritto all’impunita`”. L’affidamento all’estinzione del reato non puo` essere rivestito con i panni delle garanzie costituzionali, perche´ un affidamento all’impunita` ripugna allo stesso principio sostanziale di legalita`. La ragionevole “brevita` del processo” e` altra cosa dalla prescrizione. La sentenza Taricco della Corte di giustizia UE consente di giungere a queste conclusioni, riprese dalla Cassazione, pur con esiti difformi, nelle sentt. nn. 2210/16 e 7914/16.
