About derivatives amid worthiness of interest and effectiveness of protection: “quid noctis”? Abstract: The author of this essay, while refuses the common idea that derivatives contracts are exempted from any judgement regarding worthiness of parties’ interests, points out that investors’ protection, according to the current legal debate, can rely upon multiple remedies at law. Defending the point that a purely speculative derivative does not fulfill the requirement of worthiness according to article 1322 of the Italian civil code, the author argues that the choice for the most effective remedy ought to be led by the idea that pure speculation is insufficient to justify a legally-protected enrichment.
