The paper gives a critically overview of the legal framework for payment services focusing on the directive 2007/64/EC, the legislative decree n. 11/2010 and the Bank of Italy’s regulations. Provided the state of payment instruments, the Author drives its attention to the payment account as a framework contract for the provision of payment services as well as to the duties and rights of the professional providers and the users.
