The essay provides a constitutional as sessment of Law No. 76 of 2016 ten years after its enactment. It argues that the central issue is no longer the legal recognition of same-sex couples, but the continuing justification of the dual -track regime separating civil unions from marriage. In light of Italian constitutional case law, the European Convention system and EU law, civil unions appear as a family status grounded in Articles 2 and 3 of the Constitution and marked by a solidarity-based structure largely convergent with marriage. The essay t herefore highlights the tension between normative assimilation and symbolic separation, concluding that the remaining differences between the two institutions require increasingly strict constitutional scrutiny.
Il saggio propone un bilancio costituzionale della legge n. 76 del 2016 a dieci anni dalla sua approvazione. L’analisi sostiene che il problema non sia più il iconoscimento delle coppie same-sex, ormai acquisito, ma la persistente giustificazione del doppio binario tra unione civile e matrimonio. Alla luce della giurisprudenza costituzionale, convenzionale ed eurounitaria, l’unione civile emerge come status familiare fondato sugli artt. 2 e 3 Cost., caratterizzato da una sostanza solidaristica largamente convergente con quella matrimoniale. Il contributo evidenzia così la tensione tra assimilazione normativa e separatezza simbolica, concludendo che le differenze residue tra i due istituti devono essere sottoposte a un controllo sempre più rigoroso di ragionevolezza costituzionale.
