The crime of corruption in judicial acts, inexplicably left on the margins of successive legislative reforms aimed to reshaping the system of crimes committed by public officials against the public administration, remains plagued by multiple problematic issues, concerning both its internal structure ad its relationship with other criminal offenses with which it may overlap. In the present contribution - after isolating two issues that remain particularly controversial and that relate to each of the two perspectives - first the discussion is focused on the question of whether a witness may be regarded as falling within the category of the potential perpetrators of the offense; then, the analysis turns to the interplay between corruption in judicial acts and obstruction of justice, on the one hand, and between corruption in judicial acts and perjury, on the other.
Il delitto di corruzione in atti giudiziari, rimasto incomprensibilmente ai margini dei reiterati interventi normativi tesi a rimodellare l’assetto dei delitti dei pubblici ufficiali contro la pubblica amministrazione, continua ad essere afflitto da molteplici nodi problematici, relativi tanto alla sua dimensione “interna” quanto ai rapporti con quelle fattispecie incriminatrici con cui può entrare in contatto. Nel presente contributo - previa selezione di due profili a tutt’oggi particolarmente controversi ed afferenti all’una ed all’altra prospettiva - dapprima ci si sofferma sulla questione relativa all’ascrivibilità del testimone tra i soggetti attivi del reato; poi, ci si interroga su quale sia la relazione che intercorre tra corruzione in atti giudiziari ed intralcio alla giustizia, da un lato, e tra corruzione in atti giudiziari e falsa testimonianza, dall’altro.
