L’ART. 28 DELLA COSTITUZIONE E LO SCUDO ERARIALE

The author proposes a minority interpretation of Article 28 of the Italian Constitution, which today seems to respond better than traditional interpretation to needs of contemporary democracy, in light of the amendments medio tempore made to the original text. In particular, the microsystem that revolves around the reinterpreted Article 28 is used to evaluate the accounting justice reform proposals currently under consideration by the Senate of the Italian Republic.

L’A. ripropone una lettura minoritaria dell’art. 28 della Costituzione repubblicana che oggi sembra rispondere meglio di quella tradizionale alle esigenze della democrazia contemporanea alla luce delle modifiche al testo originario della Carta intervenute medio tempore. In particolare, il microsistema che ruota attorno all’art. 28 Cost. reinterpretato viene utilizzato per valutare le ipotesi di riforma della giustizia contabile attualmente in discussione al Senato.
