Sulla tutela dei creditori particolari del legittimario pretermesso

The ordinance of the Second Civil Section of the Corte di Cassazione deals with the complex issue of protecting the interests of the creditors of a necessary heir in circumstances where, at the time of his death, the estate is found to be insolvent, and the heir has not taken any measures to protect his rights under the law. The existence of different case law on the possibility of acting by subrogation and the idea that there is a lack of effectiveness in the protection of creditors’ rights in the specific case where the heir is ineligible to inherit due to the lack of an estate, suggested that the question be brought before the United Sections of the Supreme Court.

L’ordinanza della Seconda Sezione Civile della Corte di cassazione affronta la complessa questione della tutela degli interessi dei creditori del legittimario pretermesso che non eserciti l’azione di riduzione per tutelare i propri diritti. L’esistenza di una difformità di orientamenti giurisprudenziali sulla possibilità e i limiti di un’azione surrogatoria è l’assenza di una tutela effettiva dei creditori nel caso specifico in cui il legittimario sia stato pretermesso, hanno suggerito l’eventualità di proporre la questione alle Sezioni Unite della Corte di cassazione.
