Sul ruolo dell’inventario nella procedura di accettazione beneficiata

The essay addresses the complex issue of the consequences of a legal representative of a minor’s failure to create an inventory in accordance with the terms of their inheritance. In anticipation of the unified sections of the Court of Cassation’s interpretation of article 489 of the Civil Code, the essay proposes an analytical review of the most recent jurisprudence that has considered the discipline of the inventory benefit.

Il saggio affronta il delicato tema delle conseguenze derivanti dall’omessa redazione dell’inventario da parte del legale rappresentante del minore che abbia accettato l’eredità con beneficio di inventario. In attesa che sul punto si esprimano le sezioni unite della cassazione circa l’interpretazione da attribuire all’art. 489 c.c., il saggio si propone di analizzare criticamente l’orientamento giurisprudenziale più recente che ha ritenuto di inquadrare la disciplina del beneficio di inventario nella cornice teorica della fattispecie a formazione progressiva.
