In Judgments Nos. 68 and 69, issued on 22 May 2025, the Constitutional Court examined the constitutionality of Articles 5 and 8 of Law 40/2004. In one case, the Court affirmed the right of a child born to a same-sex couple to automatic recognition of their status, including in relation to the so-called intentional mother. In the other case, the court did not acknowledge a single woman’s constitutional right to access medically assisted procreation. In reaching these decisions, the court applied two key principles: the best interests of the child and the couple’s consent. In a dialogue with Guglielmo Bevivino, this essay examines the concept of couples’ consent as a basis for parental responsibility and as a prerequisite for the application of medically assisted procreation techniques.

Con le sentenze n. 68 e 69 del 22 maggio 2025, la Corte costituzionale ha sindacato la costituzionalità rispettivamente degli art. 8 e 5 della l. 40/2004, in un caso, sancendo il diritto del figlio nato da coppia same–sex al riconoscimento automatico del proprio status anche rispetto alla madre c.d. intenzionale, nell’altro non riconoscendo alla donna single un diritto di rilievo costituzionale all’accesso alla procreazione medicalmente assistita. Nel farlo, la Corte ha impiegato due principi, il migliore interesse del bambino e quello del consenso della coppia, in funzione di limite o condizione del diritto all’autodeterminazione procreativa. In dialogo con Guglielmo Bevivino, il saggio di Massimo D’Auria approfondisce il profilo del consenso della coppia quale titolo della responsabilità genitoriale e quale condizione per l’applicazione delle tecniche di procreazione medicalmente assistita.
