The contribution focuses on the different interpretations of the European ne bis in idem principle. The prohibition of a second trial, a principle that is as classic as it is constantly evolving, has gradually found its place in the case law of Strasbourg and Luxembourg, having now become an undisputed fundamental right of the individual. The paper focuses on three essential aspects of the guarantee. The first is that of the “same offence”, the essential prerequisite of ne bis in idem. The second relates to the double track sanctioning systems and, therefore, to the scope of the overall punitive response that States can implement. Finally, the transnational dimension of ne bis in idem is highlighted, as it is an excellent litmus test for gauging the state of progress of cooperation between States in a supranational organization such as the European Union.
Il contributo si concentra sulle diverse declinazioni del ne bis in idem europeo. Il divieto di un secondo giudizio, principio tanto classico quanto in continua evoluzione, ha man mano trovato sempre più posto nella giurisprudenza di Strasburgo e Lussemburgo, essendo ormai divenuto un indiscusso diritto fondamentale della persona. L’articolo si sofferma su tre snodi essenziali della garanzia. Il primo è quello del “medesimo fatto”, il presupposto essenziale del ne bis in idem. Il secondo si lega, invece, al doppio binario punitivo e, dunque, all’ampiezza della risposta sanzionatoria che gli Stati possono mettere in atto. Da ultimo, viene messa in evidenza la dimensione transnazionale del ne bis in idem, ottima cartina di tornasole per saggiare lo stato di avanzamento della cooperazione tra Stati in un’organizzazione sovranazionale come l’Unione Europea.
