L'accettazione del rischio nello svolgimento dell'attività sportiva

The risk acceptance in the performance of sports activities. ABSTRACT: This paper, based on a Supreme Court ruling on the injury caused to an athlete during the practice of a sport activity, aims to review the positions of doctrine and jurisprudence on liability in sports. In practicing a sport, particularly a sport «where the contact is required», it is inevitable to consider a certain level of risk to which the athlete implicitly consents; therefore, in these cases it is necessary to verify whether the injury event was intentional and whether the behavior adopted by the athlete complied with the rules of the sport activity.

Il presente lavoro, partendo da una pronuncia della Suprema Corte relativa al danno cagionato ad un atleta durante l’esercizio di un'attività sportiva, si propone di ripercorrere le posizioni della dottrina e della giurisprudenza in materia di responsabilità civile in ambito sportivo. Nella pratica di una disciplina sportiva, in particolare negli sport a contatto necessario, è inevitabile considerare un certo livello di rischio al quale l'atleta acconsente implicitamente; pertanto, in questi casi bisogna verificare se l’evento lesivo fosse voluto e se il comportamento adottato dall’atleta fosse conforme alle regole di gioco.
