Le minoranze linguistiche nella Costituzionae. Attualità e potenzialità dell'art. 6

After recalling the drafting of Article 6 of the Constitution and its implementation by Law No. 482/1999, the essay deals with the up-do-date character and potential of this Fundamental Principle. The transformations of the society seem to open up the possibility of an evolutionary interpretation of Article 6, such as to include, under certain conditions, among linguistic minorities “other” communities that have been neglected until now. This interpretation would also make it possible to overcome the traditional opposition between majority and minorities with the aim of imagining a more inclusive society for all.

Dopo aver richiamato i lavori preparatori dell’art. 6 Cost. e la sua attuazione ad opera della legge n. 482/1999, il contributo riflette sull’attualità e sulle potenzialità di questo Principio fondamentale. Le trasformazioni del tessuto sociale sembrano aprire alla possibilità di una lettura evolutiva dell’art. 6 e tale da ricomprendere, a certe condizioni, tra le minoranze linguistiche “altre” collettività finora trascurate. Tale lettura consentirebbe inoltre di superare la tradizionale contrapposizione tra maggioranza e minoranze con l’obiettivo di immaginare una società più inclusiva per tutti.
