La sauvegarde de l’environnement dans le cadre de la liquidation judiciaire italienne d’une entreprise en crise: problèmes de recherche et solutions envisageables

This article critically investigates the intersection between corporate insolvency proceedings— particularly judicial liquidation—and environmental protection under Italian law. It brings to light the enduring misalignment between the Business Crisis and Insolvency Code (CCII) and environmental legislation, which undermines the effective internalization of environmental costs generated by corporate polluters. Special emphasis is placed on the difficulties in enforcing the “polluter pays” principle when the debtor lacks financial capacity, and on the uncertain legal position of insolvency trustees dealing with polluted assets.
