The essay considers whether the context of banking governance has undergone a renewal. The clues are sought in the process of assuming ES factors in common law in France, after the introduction of the loi PACTE, and among the reflections of the US literature on the requirements of bank representatives (Fit and Proper), which allow a review of their function within the framework of bank governance theory. The aim is to initiate a reflection on the future of the regulation of corporate banking governance in Europe.
