The constitutional reform of articles 9 and 41 favors a reflection on the relationship between private autonomy, commercial contracts and environmental issues. The effectiveness of sustainability can be appreciated through the mandatory rules: in this sense, useful ideas come from the Energy Performance Contracts, from the sustainability agreements (according with Guidelines on the applicability of Article 101 of the Treaty on the Functioning of the European Union to horizontal co-operation agreements) and from the energy and environmental sustainability criteria set off by the new public procurement code.
