Third Sector Entity as Guardian. ABSTRACT: The essay intends to deepen the possible judicial appointment of Third Sector institutions as guardian. Attention should be paid to the role of private bodies – including voluntary organisations and philanthropic organisations – and to the capacity of these entities to exercise a solidarity action in accordance with principle of horizontal subsidiarity. Integration between Civil Code and Third Sector Code is suggested, with specific reference to the protection of subjects lacking in all or part of autonomy: a systematic and functional approach is therefore necessary.
