Management algoritmico e asimmetrie informative di ultima generazione

Title: Algorithmic management and state-of-the-art information asymmetries Abstract [En]: In the face of an increasingly widespread use of algorithms in the corporate decision-making processes, this essay aims to highlight how the complexity and opacity of these algorithms impact the level of informational asymmetry that already characterizes the relationship between the employer and the employee, further accentuating the contractual weakness of the worker. Regarding these new needs for worker protection, the Author intends to reflect on the adequacy of the regulatory technique based on information rights and principle of transparency characterizing the most recent legislative interventions.

A fronte di un utilizzo sempre più diffuso degli algoritmi nell’ambito dei processi decisionali aziendali, il presente contributo vuole mettere in evidenza come la complessità e l’opacità di questi incidano sul grado di asimmetria informativa che già connota il rapporto fra il datore e il prestatore di lavoro, andando ad accentuare la condizione di debolezza contrattuale del lavoratore; rispetto a queste nuove esigenze di tutela dei lavoratori, l’Autrice intende riflettere sull’adeguatezza della tecnica regolativa fondata sui diritti di informazione e sul principio di trasparenza che caratterizza i più recenti interventi legislativi.
