Termini dei procedimenti sanzionatori delle Autorità indipendenti e principio di legalità

The essay examines the issue of the nature of the time limits for initiating and concluding sanctioning proceedings of independent regulatory authorities. The Author examines the different case-law orientations highlighting their critical aspects. Subsequently, she demonstrates that, in compliance with the principle of legality that applies to sanctions, as recently interpreted by the Constitutional Court in sentence no. 151 of 2021, the most correct solution is to consider that both terms are of a forfeiture nature and that their violation determines the consummation of the power, with the consequent nullity of the sanction adopted late.

Il saggio analizza la questione della natura dei termini di avvio e di conclusione dei procedimenti sanzionatori delle Autorità amministrative indipendenti, esaminando i diversi orientamenti giurisprudenziali presenti in materia e mettendo in evidenza le criticità. Successivamente si dimostra che, alla luce della riserva di legge e del principio di legalità operante in materia sanzionatoria, per come recentemente interpretati dalla Corte costituzionale nella sentenza n. 151 del 2021, la soluzione più corretta è ritenere che entrambi i termini abbiano natura decadenziale e che la loro violazione determini la consumazione del potere, con conseguente nullità della sanzione tardivamente adottata.
