L'effettività oltre la forma: gli ostacoli fattuali per l'accesso al giudice dell'asilo in Italia e in Francia

Effectiveness Beyond the Form: Factual Barriers to the Access to the Asylum Judge in Italy and France. ABSTRACT: The essay aims to verify whether the judicial phase of the proceeding for granting the right to asylum in Italy and in France takes into account the specificities of the subjects involved, by providing for procedural tools able to compensate or eliminate the factual barriers faced when bringing the action before the judge. For that purpose, it specifically focuses on three main aspects of the topic (time, language, and economic resources), in order to test the two national systems in the light of the right to an effective remedy.
