La notizia di reato: sagoma, tempi di iscrizione e controlli

News of crime: outline, times of registration and controls. ABSTRACT: In order to reduce the excessive length of criminal proceedings, the so called “Cartabia reform” has also introduced provisions with regards to preliminary investigations, i.e., the introduction by the delegated legislator of a jurisdictional control over the prompt registration of the news of crime and of the name of the suspect. In particular, the judicial control concerning the “prompt” registration added to the further possible control regarding the public prosecutor’s request to continue the investigations into the already filed case, aims at ensuring compliance with the complex system of the maximum terms of duration of preliminary investigations. It may happen, in fact, that the prosecutor simply delays the registration of the notitia criminis, thus negatively affecting the overall timing of the procedure. Nevertheless, it is necessary to investigate first if such provision could undermine the public prosecutor’s functional autonomy and then face those issues concerning future application aspects of this reform.

Al fine di ovviare all’eccesiva durata dei procedimenti penali italiani, la c.d. “riforma Cartabia” ha provveduto anche in relazione alle indagini preliminari: ha disposto che il legislatore delegato introduca un controllo giurisdizionale sulla tempestiva iscrizione oggettiva e soggettiva delle notizie di reato. In particolare, proprio la verifica giudiziale sulla “tempestività” delle iscrizioni (cui si è aggiunto l’ulteriore eventuale controllo circa la richiesta del pubblico ministero di proseguire le investigazioni sul caso già archiviato) è diretta ad evitare che l’accusa, semplicemente ritardando l’iscrizione della notitia criminis, possa riuscire ad aggirare l’articolato sistema dei termini di durata massima delle indagini preliminari, con evidenti ripercussioni negative sulla complessiva tempistica processuale. Occorre verificare, però, innanzitutto, se siffatta direttiva possa portare a pregiudicare l’autonomia funzionale del pubblico ministero; per, poi, affrontare gli interrogativi che attengono ai futuri aspetti applicativi della riforma.
