The paper analyzes the issue of the division of jurisdiction between ordinary and administrative judges in matters of fundamental rights. The Court of cassation (Joint Divisions, ord. 15.2.2022, no. 4873), modifying the decision of the trial judges, affirmed the ordinary jurisdiction in a judgment aimed at ascertaining the violation of the right to health of asylum seekers hosted in an extraordinary reception center. The analysis of the case allows to demonstrate that the involvement of a constitutional right implies a specific way of reconstructing the relationship between subjective situations and administrative power. Therefore, the so-called «theory of fundamental rights» is useful, even more than as a criterion for the division of jurisdiction, to define the type of control that any judge (ordinary or administrative) can carry out in the administrative activity that affects fundamental rights. In fact, the direct application of the constitutional provision (in this case, article 32 of the Constitution) makes it possible to identify specific obligations for public administration that can be enforced in the Courts.

Il contributo analizza la questione del riparto di giurisdizione in materia diritti fondamentali, prendendo le mosse dall’ordinanza n. 4873 del 15 febbraio 2022 con cui le SU della Corte di cassazione hanno affermato la giurisdizione ordinaria in un giudizio diretto ad accertare la violazione del diritto alla salute dei richiedenti asilo ospitati in un Centro di accoglienza straordinaria (CAS), per effetto della mancata attuazione delle misure di prevenzione del contagio da Covid-19. L’analisi della vicenda offre l’occasione per considerare il tema generale e dimostrare che il coinvolgimento di un diritto costituzionalmente protetto implica un certo modo di ricostruire il rapporto tra situazioni soggettive e potere amministrativo che ha specifiche implicazioni, prima ancora che sul sistema di riparto delle giurisdizioni, sul tipo di sindacato giurisdizionale esercitabile sull’attività amministrativa. Ciò perché l’applicazione diretta della norma costituzionale di riconoscimento del diritto (nella specie l’art. 32 Cost.) consente di individuare specifici obblighi di comportamento in capo alle PA pienamente tutelabili davanti al giudice.
