Smart home devices are increasingly bought by consumers. After an overview on which rules include in their scope the use of these goods, the main focus is on data protection and consumer protection. The utmost account is taken of the GDPR and the EU directives concerning business-to-consumer digital contracts. Moreover, the article points out that national contract law, in particular national sales law, does not fit the purchase of smart home devices as the concept of ownership is blurred by that one of access.
