Article 10 paragraph 3 of the Italian Constitution attributes the right to asylum to all foreigners to whom in their home country the exercise of the democratic liberties contemplated by the same Constitution is denied. Over the years, Italian courts have interpreted this provision in different ways. This article critically examines the Italian jurisprudence concerning the application of the said provision.
