Between «lex commissoria» and «precaria possessio»: the first conceptualization of the reservation of ownership in the glossators. ABSTRACT: This paper deals with the study on the theoretical origin of the reservation of ownership or retention of title (pactum reservati dominii or pactum de dominio retinendo). Thanks to the examination of the manuscript sources, it has been possible to discover the first conceptualization of this special covenant in the thought of 12th century glossators. The doctores bononienses, debating about the differences between the pactum legis commissoriae and the case regulated by Cod. 4.54.3, claimed that the sale with deferred payment and delivery of thing sold only as precaria possessio, left the ownership to the seller (quod si fecit dominium apud se retinuit).
