The present essay analyses Athenian finances during the fourth century BC, the primary level of allocation and distribution, which the Athenians called merismos, and the management of surplus. According to a city’s law, the surplus and/or unallocated revenues were assigned to the military fund in wartime, to the Theoric fundin peacetime. Demosthenes and Apollodorus tried, in many occasions, to transfer the surplus to the war fund even in peace time. During one of these attempts Apollodorus was publicly accused and tried. We will investigate which was the accusation charged against him and why he lost the trial.

Nell’Atene del IV secolo le distribuzioni delle entrate pubbliche tra le varie casse era re-golamentata dai nomoi. Tra i principali fondi la Cassa per gli Spettacoli era senza dubbio la destinataria di ingenti allocazioni. Anche le eccedenze venivano ripartite in base alle disposizioni di una legge della città: in tempo di pace venivano indirizzate al Theorikon e in tempo di guerra alla Cassa militare. Non tutti erano però concordi su questa spartizione: Apollodoro e Demostene si esposero in più occasioni nel tentativo di far abrogare o modificare questo nomos. Durante uno di questi tentativi Apollodoro venne coinvolto in una causa giudiziaria e condannato. Cercheremo di capire quale fu l’accusa alla base dell’azione giudiziaria e come mai Apollodoro non riuscì ad ottenere il consenso dei giurati.
