Il contributo di Calamandrei alla delineazione della forma di governo nella Costituzione (1943/1948)

The paper deals with the contribution of Calamandrei to the construction of the Republican Italy, thus highlighting his contribution to the shaping of the form of government within the Constitution. After a brief analysis concerning the fall of the Fascist regime and the very dawn of the Constituent Assembly, the Author dwells on the role played by Calamandrei in the debate took place in the Second Subcommittee on the presidential form of government. The paper then analyses the solution retained by the Constituent Assembly, which reflects the revenge of the political logic. The work ends with an analysis of the battle handled by Calamandrei for the implementation of the Constitution, and in particular on the role of the constitutional guarantee’s bodies

Il saggio ripercorre il contributo dato da Calamandrei alla costruzione dell’Italia repubblicana ponendo l’accento sul suo apporto alla delineazione della forma di governo nella Costituzione. Dopo una breve premessa sulla caduta del regime fascista e sugli albori dell’Assemblea costituente, l’A. si sofferma sul ruolo svolto da Calamandrei nel dibattito in II sottocommissione sulla forma di governo presidenziale. Viene poi analizzata la soluzione accolta in Assemblea costituente, che testimonia la rivincita della logica politica Il saggio si conclude poi con l’analisi della battaglia di Calamandrei per l’attuazione della Costituzione, e in particolare sul ruolo degli organi di garanzia costituzionale
