In this judgement, the Court of Cassation identifies the procedure of the precautionary judgment following the annulment of the order with which the measure was ordered or confirmed. As there isn’t indications from the article 311, comma 5-bis, c.p.p., the judges shall prescribe that the period of ten days for taking a decision shall run from the date on which the documents newly requested get to the judicial authority at the registry of the court, ex art. 309, comma 5, c.p.p. But the Court’s decision does not entirely convince the interpreter. In order to provide adequate protection for the complex of safeguards of the precautionary proceeding, a solution is proposed which makes it possible to balance the need for speed of judgments with those of completeness

Con la pronuncia in commento, le Sezioni unite tratteggiano l’iter procedimentale del giudizio di rinvio cautelare: in assenza di specifiche indicazioni provenienti dall’esegesi del comma 5-bis dell’art. 311 c.p.p., i giudici blindano l’opzione per cui il termine di dieci giorni entro cui il giudice ha l’obbligo di decidere decorre dal momento in cui pervengono alla cancelleria del tribunale gli atti nuovamente richiesti all’autorità giudiziaria procedente, secondo l’ordinaria sequenza temporale delineata dall’art. 309, comma 5, c.p.p. con riferimento al giudizio di riesame. La decisione della Corte – per quanto ben articolata e strutturata in punto motivazionale – non convince del tutto circa gli approdi raggiunti, sia per ragioni teleologiche che assiologiche. Al fine di offrire adeguata tutela al complesso di garanzie che sottende il procedimento di rinvio cautelare, si propone una soluzione che consente di contemperare le esigenze di celerità con quelle di completezza.
