From “states of exception” to the constituent process. A first glance of the recent Chilean experience –The Chilean constituent process was launched last October 2020, close to a “state of emergency” and in the midst of a “state of disaster”. Declared, at different times and for different reasons, by the President of the Republic, both are amongthe states of exception, provided for by the Constitution in force and regulated by an organic law. The article aims at welding the implications of those phenomena with the genesis of the process that should lead, between 2021 and 2022, to the drafting ofthe new Constitution.
