The Covid-19’ emergency is having two important implications for the administrative justice: on one hand, it is used as a pretext to rethink the role of the administrative judge in the administrative justice system designed by the Constitution; on the other hand, it has reserved to the administrative process a different treatment within the dispositions generally dictated in order to govern the development of the judicial activity in the period of the emergency. This should lead to a critical reflection on the relationship of the administrative process with the general principles of the process and, in addition, it should underlines the need for this relationship to be safeguarded also in order to preserve the centrality of the administrative judge in the administrative justice system.
L’emergenza Covid 19 sta avendo due importanti implicazioni per la giustizia amministrativa: da un lato, viene invocata come pretesto per ripensare il ruolo del giudice amministrativo nel sistema di giustizia amministrativa disegnato dalla Costituzione; dall’altro, ha riservato al processo amministrativo un trattamento differenziato nell’ambito delle disposizioni generalmente dettate per governare lo svolgimento dell’attività giudiziaria nel periodo dell’emergenza. Ciò deve indurre a riflettere criticamente sul rapporto del processo amministrativo con i principi generali del processo e a sottolineare la necessità che tale rapporto venga salvaguardato anche al fine di preservare la centralità del giudice amministrativo nel sistema di giustizia amministrativa.
