The last habitual residence of the deceased: potentials and challenges

The paper aims to explore the potentials and challenges of the last habitual residence of the deceased in the framework of Regulation EU 650/2012 either in the conflict-of-laws or in the conflict-of-jurisdictions. In that regard, it first investigates, from a theoretical point of view, its founding justifications. It then describes, from a practical point of view, the method for its ascertainment, with regard, in particular, to complex situations, where the operation of the criterion may prove difficult.

Lo scritto intende esplorare le potenzialità e le criticità del criterio dell’ultima residenza abituale del de cuius nel quadro del Regolamento UE 650/2012 sia come criterio di collegamento sia come titolo di giurisdizione. A tale riguardo, esso indaga, innanzitutto, da un punto di vista teorico, il fondamento logico del criterio. Successivamente, da un punto di vista pratico, descrive il metodo per il suo accertamento, con riguardo, in particolare a situazioni complesse.
