The hermeneutic analysis of the regulation concerning unfair commercial practices reveals the possibility of a systematic reconstruction of the market regulation designed on the idea that business and consumption represent two conflicting interests cast on an equal level. Among other available techniques, in this perspective the State – legislator uses private law aiming at boosting the competition so to ensure an optimal market dynamic.

Il saggio, attraverso l’analisi ermeneutica della disciplina delle pratiche commerciali scorrette, propone una ricostruzione sistematica della regolazione del mercato concorrenziale edificata sull’equipollenza di impresa e consumo come interessi conflittuali. In tale direzione di analisi il diritto privato costituisce una delle tecniche utilizzate dallo Stato-legislatore per assicurare il buon funzionamento del mercato e, quindi, per generare concorrenza.
