The essay firstly examines the trends which have characterised the exercise of legislative powers in Italy since the redefinition of the European economic governance within the framework of the global financial crisis. The analysis correlates the forms of the legislation and its contents, starting from the assumption that the first ones have evolved according to the new context, in such a way as to assure the implementation of a precise “conditioned policy”, defined at the European level within a framework of asymmetric intergovernmentalism. It confirms that the new context has actually had an outstanding impact, as it has remarkably strengthened the Government’s tendency to expand its role and consequently to reduce the role of the Parliament, particularly in the fields of social policies and labour law. The analysis subsequently focuses on the reaction of the Italian Constitutional Court to the recent reforms which have affected the Welfare State and to the related abuses committed by the Government in the exercise of legislation. Finally, this makes possible to express some critical evaluations: about the development of the relationship between the European and the national legal systems; about the close relationship between the democratic question and the social question (particularly between the changes affecting the sources of law and the protection of social rights) in the present context; about the role played by the Courts and namely about the actual and potential role of the Italian Constitutional Court.

Nell’articolo si analizzano, in primo luogo, le modalità che hanno caratterizzato l’esercizio della funzione legislativa nella fase successiva alla ridefinzione della governance economica europea nel contesto della recente crisi finanziaria internazionale. L’esame pone in stretta relazione forme e contenuti della legislazione, muovendo dall’assunto che le prime si sono evolute in maniera funzionale ad assicurare il conseguimento di obiettivi riconducibili all’ “indirizzo politico condizionato” definito a livello europeo in una cornice di intergovernamentalismo asimmetrico; e fa così risaltare il significativo impatto del nuovo contesto, che ha accentuato le preesistenti tendenze all’espansione del ruolo del Governo e alla corrispondente marginalizzazione del Parlamento, in maniera particolarmente evidente nel settore delle politiche sociali e del lavoro. L’analisi è quindi completata dall’esame della reazione della Corte costituzionale di fronte alle politiche di ridimensionamento dello Stato sociale e alle evidenziate prassi distorsive nell’esercizio della legislazione. Su queste basi sono espresse alcune valutazioni critiche, che riguardano l’evoluzione del rapporto fra ordinamento nazionale e ordinamento europeo; lo stretto legame tra questione democratica e questione sociale (trasformazioni del sistema delle fonti e garanzia dei diritti) nel contesto di tale evoluzione; infine, il ruolo delle Corti e specificamente il ruolo attuale e potenziale della Corte costituzionale.
