La dignidad en la Constitución Cubana de 2019 y en dos notas comparadas: dimensiones de análisis y retos para el juez

Human dignity is a superior legal value. Although the Cuban Constitution of 1976 conferred special recognition on the preamble and within the aims of the socialist state, the constitutional reform in 2019 resizes it and directly links it to the interpretation and safeguard of constitutional rights. The objective of this paper is to offer criteria about the character that currently reaches this value in Cuba, comparing it with the role it plays in the Italian and German systems. General guidelines will be proposed for their assessment in the judicial application of Law in Cuba, based on its current constitutional configuration.
