Under the current legislation, income stemming from financial investments is taxed according to three different regimes – directly through the income tax return, with the administrated saving method and with the managed saving method – strongly differentiated in relation to various and significant aspects: their objective field of application; the role of financial intermediaries; the specific rules for determining the taxable base; the relevance of income production costs; the timing of taxation. In the present paper, a critical analysis of the structural characteristics of the three regimes will be carried out, in order to check the system overall consistency in terms of fairness and effectiveness of taxation, and to outline possible reforms.
Nell’ordinamento vigente, i redditi di natura finanziaria sono tassati secondo tre distinti regimi – regime dichiarativo, risparmio amministrato e risparmio gestito – fortemente differenziati in relazione a molteplici e significativi profili, che interessano principalmente: il loro ambito oggettivo di estensione (solo in taluni casi comprensivo di entrambe le categorie reddituali); il ruolo riconosciuto agli intermediari finanziari; le modalità di determinazione della base imponibile; la rilevanza dei costi di produzione del reddito; la tempistica di applicazione del prelievo. Nel presente lavoro si procederà ad una analisi critica delle caratteristiche strutturali dei tre regimi, al fine di verificare la tenuta complessiva del sistema in termini di omogeneità del prelievo e di equità dell’imposizione, e di delineare possibili interventi di riforma.
