The paper analyses the issue of the fake news contaminating the political debate. Particular attention will be paid to an important decision of the Mexican Federal Electoral Tribunal (TEPJF), which is decision n. 143/2018. The paper starts with an introductory analysis of the definition of fake news, as well as the exam of the theoretical problems faced in the decision. The case before the TEPJF is then examined. The paper points out that the judges are called to face the expansion of the use of social networks as political propaganda tools. In the light of the spread of these phenomena, the European political class has not remained inactive. This is especially true as for the German Parliament, the French legislator and the European Union too. Obviously, the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECHR) have been involved in this context, since they have always attempted to find a difficult balance between the freedom of expression and thought and other fundamental values. Finally, the paper aims to answer some questions, notably: may legislative measures facilitate to recognise the fake news contaminating the political debate? If so, which is the attitude of social networks toward these legal limits?

Lo studio analizza il tema delle fake news, che contaminano il dibattito politico, prestando particolare attenzione a una decisione importante del Tribunale elettorale del potere giudiziale della federazione (TEPJF) del Messico, la sentenza n. 143/2018. Dopo una introduzione sopra la definizione di fake news e i problemi teorici che si affrontano nella sentenza, viene esaminato il caso affrontato dal TEPJF Lo studio prosegue puntualizzando che i giudici sono chiamati ad affrontare l’esplosione dell’uso dei social network come strumenti di propaganda politica. Di fronte alla diffusione di questi fenomeni, la classe politica in Europa non è rimasta inerte, specialmente il Parlamento tedesco, il legislatore francese; e anche l’Unione europea. In questo contesto, ovviamente, si sono inserite anche la Corte di giustizia dell’Unione europea e la Corte europea dei diritti dell’uomo, che devono sempre individuare un difficile equilibrio tra la libertà di espressione del pensiero e altri valori fondamentali. Infine, l’obiettivo è di rispondere ad alcune domande, in particolare: sono utili interventi normativi per permettere agli utenti di riconoscere le notizie false che contaminano il dibattito politico e, in tal caso, qual è l’atteggiamento dei social network contro questi limiti normativi?
