This contribution analyses, in a comparative perspective with the French legal system, the sensitive issue of enforcing an order for the return of the child issued during or after separation or divorce proceedings. The starting point of the article is that, given the extremely delicate nature of the rights and positions concerned, such orders cannot be properly carried out in the manner envisaged for the ordinary enforcement of judicial decisions. The Italian way of enforcing such orders has been characterized for a long time by measures that were ineffective and not suited for this task, taken from enforcement proceedings to obtain delivery of a thing or repossession of a property or from proceedings aimed at enforcing an order to do or to abstain from doing something, all providing for the use of some form of «force». On the contrary, from the very beginning France chose the path of the so-called «indirect procedural enforcement» using the instrument of astreintes, i.e. coercive measures aimed at ensuring compliance with court’s orders through the technique of threatening or actually ordering payment of an ever-increasing sum of money, measured in relation to the assets and capacity of resistance of the non-complying parent. Astreintes, coupled with other ad hoc instruments and effective criminal sanctions, have created in France a composite model which seems to have inspired the Italian legislator when it introduced in the code of civil procedure firstly art. 709 ter and then art. 614 bis c.p.c., labelled the Italian astreinte and employed also to ensure compliance with personal order relating to children.

L'articolo esamina, in prospettiva comparatistica con il sistema francese, il delicato problema dell'attuazione degli obblighi di consegna dei minori per effetto dei provvedimenti adottati nel corso o all'esito di un provvedimento separativo o di divorzio. Il presupposto di partenza è rappresentato dall'incensurabilità di tali obblighi di essere compiutamente attuati con le ordinarie forme del processo esecutivo, considerata la delicatissima natura dei diritti coinvolti. Se il sistema italiano si è per lungo tempo confrontato con misure tanto poco efficaci quanto sostanzialmente inadatte attingendo dal processo esecutivo ed in particolare dall'esecuzione per consegna o rilascio e quella di obblighi di fare e di non fare e comunque l'utilizzo di forme di "forza", l'ordinamento francese ha intrapreso fin dall'inizio a direzione della cd. "esecuzione processuale indiretta" utilizzando lo strumento delle astreintes, misure coercitive volte ad assicurare il rispetto dei provvedimenti tramite la tecnica dell'induzione all'adempimento sotto la minaccia o la condanna al pagamento di una somma di denaro indefinitamente crescente, misurata in base al patrimonio e alla capacità di resistenza de genitore inadempiente. Le astreintes, unitamente ad altri strumenti ad hoc ed ad una efficace tutela penale danno vita in Francia ad un modello composito cui l'ordinamento italiano pare essersi quanto meno iniziato ad ispirare con l'introduzione prima dell'art. 709 ter c.p.c. e poi con l'art. 614 bis c.p.c. non a caso denominato l'astreinte italiana ed utilizzato anche per l'attuazione dei provvedimenti personali sui minori.
