Datore di lavoro transnazionale e dumping sociale nell'Unione Europea

The essay explores the recent evolution of Labour Law under the perspective of the new relevance acquired by transnational companies even in the field of individual and collective labour regulations. The the Author tries to underline the connection among the fragmentation of businesses, the legal interventions in labour law of the EU and the interpretation of it carried out by the European Court of Justice. In particular, the author focuses on the effects of the rise of letterbox companies in the EU allowed, and sometimes fostered, by European institutions and analyses the existing rules in order to fight against this phenomenon and social dumping in general.

Il saggio affronta le trasformazioni recenti del diritto del lavoro sotto la prospettiva della centralità acquisita dalle imprese transnazionali anche nel piano della regolazione normativa. L’autore cerca di collegare la pluralità della figura datoriale ricavabile dalla disciplina normativa europea in materia lavoristica con l’interpretazione che di essa ha dato la Corte di Giustizia Europea. In particolare, il saggio si sofferma sulla proliferazione delle letterbox companies permessa, quando non promossa, dalle istituzioni europee e sulle regole per combattere questo fenomeno e, in generale, la concorrenza tra imprese basata sul social dumping.
