Reservation of ownership through the examination of notarial works from the 12th to the 18th century. The Italian Formularii instrumentorum, starting from those written in Tuscany, Lombardy and Liguria, demonstrate the diffusion of emptio–venditio cum reservatione dominii in legal practice at the beginning of Modern Age. The emptio-venditio cum reservatione dominii represents a guarantee clause for the seller in case of deferred payment. In addition, it makes legal the payment of interests that otherwise would be prohibited by canon law and, consequently, also by civil law.
