Storia e diritto in Israele. Dalle leggi fondamentali alla definizione del popolo israeliano

We cannot study the law without knowing the historical phenomena. This is true for all systems, although there are experiences where the relationship between history and law is particularly evident: it is the case of Israel, a “young” State with a history of over two thousand years. Through the study of its sources, and in particular those governing the discipline of Citizenship and Immigration, we will attempt to highlight the importance of historical knowledge for the analysis of the law.

Lo studio del diritto non può prescindere da una solida conoscenza dei fenomeni storici. Questo è vero per tutti gli ordinamenti, anche se esistono delle esperienze dove il rapporto tra storia e diritto risulta particolarmente evidente: è il caso di Israele, uno Stato “giovane” con una storia di oltre duemila anni. Attraverso lo studio delle sue fonti, e in particolare di quelle che regolano la disciplina della cittadinanza e dell’immigrazione, si tenterà di mettere in luce l’importanza della conoscenza storica per l’analisi del diritto.
