The decision no. 1/2014 (that declared unconstitutional part of the electoral law used to choose the members of the Parliament) is one of the most important judgments in the history of the Italian Constitutional Court. The decision, among the other things, produces its effects on the constitutional justice’s system, as the judgement forms part of the debate on the Italian system’s effective protection of certain constitutional rights and its capability to grant the access to the constitutional control. This article aims to analyse such fundamental profile touched by the judgement no. 1/2014. More precisely, we try to show how the Constitutional Court ─while trying to overcome a shadow zone of the Italian judicial system─ adopted a new concept of relevance (rilevanza), which is more extended than the one used by the previous and strengthen jurisprudence.

Abstract
The decision no. 1/2014 (that declared unconstitutional part of the electoral law used to choose the members of the Parliament) is one of the most important judgments in the history of the Italian Constitutional Court. The decision, among the other things, produces its effects on the constitutional justice’s system, as the judgement forms part of the debate on the Italian system’s effective protection of certain constitutional rights and its capability to grant the access to the constitutional control. This article aims to analyse such fundamental profile touched by the judgement no. 1/2014. More precisely, we try to show how the Constitutional Court ─while trying to overcome a shadow zone of the Italian judicial system─ adopted a new concept of relevance (rilevanza), which is more extended than the one used by the previous and strengthen jurisprudence.File | Dimensione | Formato | |
