In today's globalized context, the impact of international law, with many binding rules on fundamental rights, has changed the traditional concept of the Constitution as the expression of sovereignty of a state in order to take on a meaning similar to a pact of coexistence, open to new values and rights from supranational istance. It has come to this openness through a process of resolution of the issues concerning the correct position of the sources from international law to the national law and also by taking into account the existence of an European system to which the single state has been partially surrendered its sovereignty. In this view, a crucial role is recognized to the European Convention on Human Rights, which with its court affected the process of constitutionalisation of international law, aimed at influencing on the one hand the content of the constitutions and on the other hand, the interpretation that the national courts give about the Convention. From this evolution, it has resulted in a model of relationship set in the theory of multilevel protection of rights and in the so called dialogue of the Courts intended to establish the priority of national law with respect to supranational law and the penetration between the different levels of protection of such regulations.

L’impatto del diritto internazionale, con le innumerevoli norme vincolanti sui diritti fondamentali ha, nell’attuale contesto globalizzato, mutato il concetto classico di Costituzione intesa come espressione di sovranità di uno stato, per assumere un significato simile ad un patto di convivenza, aperto a nuovi valori e diritti provenienti da istanze sovranazionali. A tale apertura, si è giunti grazie ad un processo di risoluzione delle problematiche riguardanti la corretta collocazione delle fonti provenienti dal diritto internazionale nell’ambito del diritto interno, nonché considerando l’esistenza un ordinamento europeo al quale il singolo stato ha ceduto parte della propria sovranità. In tale scenario, un ruolo fondamentale è riconosciuto alla Convenzione Europea dei Diritti dell’Uomo, che con il relativo organo giurisdizionale, ha inciso sul processo di costituzionalizzazione del diritto internazionale, volto ad influenzare da un lato il contenuto delle costituzioni e dall’altro l’interpretazione che le corti nazionali danno della Convenzione. Da questa evoluzione è scaturito un modello di relazione inquadrato nella teoria della tutela multilivello dei diritti ed in quella del c.d. dialogo delle Corti volti a sancire la priorità del diritto interno rispetto a quello sovranazionale e la compenetrazione tra i diversi livelli di tutela di tali ordinamenti.
