Una stagione di fioritura della libertà di pensiero è ormai alle spalle

The essay focuses on the change occurred in the last twenty years in respect to the protection of free speech, denouncing the uncertainty ruling in the literature. The openness shown by Western democracies, that could appear a final achievement, has been over the time dismantled by several exceptions, due to the rise of terrorism and the radicalization of religious beliefs. For the time being, the doctrine seems neither able to justify this change, nor to develop a new doctrine of free speech.

Il saggio esamina il mutamento subito negli ultimi vent’anni dalla protezione della libertà di espressione, mettendo in luce le divisioni che attraversano la dottrina. L’apertura fatta propria dalle democrazie occidentali, che sembrava irrevocabile, ha subito nel tempo ripetute eccezioni, specialmente in ragione della nascita del terrorismo e della radicalizzazione delle fedi religiose. Per il momento, la dottrina non sembra in grado di giustificare questo cambiamento, ma neppure di elaborare un nuovo assetto della libertà di pensiero.
