Abstract: This essay outlines the systematic framework of article 2929-bis of Italian Civil Code, to be considered as an exceptional rule of private self-enforcement of credit rights (this being an exception to the rule of article 2741 of Italian Civil Code). The features of this institution are examined through highlighting its complex effects linked to the documentary evidence of a gift contract and the outcomes of asset segregation.
