There is no doubt that sustainability has become one of the key concerns of our time, despite the vagueness and confusion surrounding what it precisely represents or how it can be achieved. Indeed, as a general concept, sustainability often appears elusive, frequently taking on different meanings. In this context, it is unsurprising that the question of whether and how labor law should address issues related to socio-ecological sustainability—and in what manner—has only recently emerged in critical debates concerning the normative scope, boundaries, and objectives of labor law and, more broadly, the instruments of labor, including industrial relations and collective bargaining. However, there is no question that labor is deeply implicated in the current socio-ecological crisis and is already at the center of various legislative proposals on how to address this environmental crisis and its impacts on individuals, communities, and territories. Is it therefore possible to envision a socio-ecological domain within labor law and industrial relations? Can the role of social partners and collective action be acknowledged within the framework of a socio-ecological transition? This research aims to address these questions by first exploring the complex interconnections between transition and the world of work. Once the context is established, the second chapter will outline the theoretical framework, delving into the conceptual complexity of the term “transition.” A wide range of perspectives will be examined—from ecological and socio-ecological transitions to energy and just transitions—with the goal of identifying the most significant challenges and opportunities for the production system, workers, and social partners. In particular, the conceptual reconstruction will be carried out from both international and national legal perspectives, as well as within the relevant literature, to clarify the concrete meanings of the various types of transitions. Subsequently, through the lens of the socio-ecological transition, the role of social partners—and, specifically, collective bargaining—in promoting an equitable and sustainable transition will be analyzed, with a focus on unresolved issues. The third chapter will be dedicated to an empirical analysis of collective bargaining in the energy-petroleum, metalworking, and banking-insurance sectors. For each sector, the measures adopted to support the ecological transition and those addressing the broader horizon of the socio-ecological transition will be examined, including training, occupational health and safety, and anti-discrimination efforts. These measures aim to promote not only environmental sustainability but also social sustainability, supporting the creation of decent jobs, protecting working conditions, and fostering democratic participation by integrating economic, environmental, and social considerations. The chapter will conclude with a comparison across the analyzed sectors, highlighting differences, points of convergence, as well as challenges and best practices in addressing the opportunities and obstacles presented by the socio-ecological transition. The study will conclude with a chapter synthesizing the main findings of the research and exploring perspectives for future studies and discussions. In this final section, the data and analyses presented in the previous chapters will be critically assessed, emphasizing the most significant conclusions and identifying areas requiring further investigation. Based on these findings, the concluding chapter will offer insights to reignite the debate on the role and function of collective agreements in light of the contractual provisions examined in the current context of ecological and social transitions.

Non vi è dubbio che la sostenibilità sia diventata una delle principali preoccupazioni della nostra epoca, nonostante la vaghezza e la confusione su cosa essa rappresenti esattamente o su come possa essere raggiunta. In effetti, come concetto generale, la sostenibilità appare spesso sfuggente, assumendo spesso significati diversi. In tale contesto, non stupisce che l’interrogativo in merito a se e come il diritto del lavoro debba affrontare le questioni legate alla sostenibilità socio-ecologica - e in che modo debba farlo - sia un quesito solo recentemente considerato nei dibattiti cruciali sulle discipline normative, i confini e gli obiettivi del diritto del lavoro e, più in generale, degli strumenti del lavoro, tra cui le relazioni industriali e la contrattazione collettiva. Tuttavia, è indubbio che il lavoro sia coinvolto nella crisi socio-ecologica attuale e sia già al centro di varie proposte politiche su come affrontare questa crisi ambientale e i suoi impatti sugli individui, sulle comunità e sui territori. È quindi possibile contemplare un ambito socio-ecologico nel diritto del lavoro e delle relazioni industriali? È possibile, in tal senso, riconoscere un ruolo delle parti sociali e del collettivo nella prospettiva della transizione socio-ecologica? La presente ricerca si interrogherà su queste questioni, affrontando e presentando dapprima le intricate interconnessioni tra transizione e mondo del lavoro. Una volta definito il contesto, il secondo capitolo si occuperà, in primo luogo, di delineare il quadro teorico di riferimento, affrontando la complessità concettuale inerente al termine “transizione”. Verrà, in tal senso, esplorato un ampio ventaglio di prospettive, dalla transizione ecologica a quella socioecologica, passando per la transizione energetica e quella giusta, al fine di individuare le sfide e le opportunità più rilevanti per il sistema produttivo, per i lavoratori e per le parti sociali. In particolare, la ricostruzione concettuale verrà operata sia dal punto di vista giuridico internazionale che nazionale, oltre che nella letteratura in materia, con l’obiettivo di chiarire cosa si intenda concretamente quando si parla dell’una o dell’altra transizione. In seguito, attraverso la chiave di lettura rappresentata dal concetto di transizione socioecologica, si analizzerà con particolare attenzione il ruolo svolto dalle parti sociali, e in particolare dalla contrattazione collettiva, nel promuovere una transizione equa e sostenibile, evidenziando le questioni ancora irrisolte. Il terzo capitolo sarà, dunque, dedicato all’analisi empirica della contrattazione collettiva nei settori energetico-petrolifero, metalmeccanico e del credito-assicurazioni. Per ciascun settore, verranno esaminate le misure adottate per supportare la transizione ecologica e quelle che si inseriscono, invece, nell’orizzonte più ampio della transizione socio-ecologica, come la formazione, la salute e sicurezza sul lavoro, e la lotta contro le discriminazioni, dunque promuovendo non solo la sostenibilità ambientale ma anche quella sociale, a sostegno della creazione di posti di lavoro dignitosi, della tutela delle condizioni lavorative e della partecipazione democratica, affrontando in modo integrato le questioni economiche, ambientali e sociali. Il capitolo si concluderà con una comparazione tra i diversi settori analizzati così da evidenziare differenze e punti di convergenza, così come criticità e best practices relative a come essi stiano (o non stiano) affrontando le sfide e le opportunità nel contesto della transizione socioecologica. L’elaborato si concluderà con un capitolo dedicato alla sintesi dei principali risultati ottenuti dall’indagine, e alle prospettive aperte per future ricerche e discussioni. In questa sezione finale, i dati e le analisi presentati nei capitoli precedenti saranno esaminati criticamente, evidenziando le conclusioni più significative e individuando le aree che richiedono invece ulteriori approfondimenti. Sulla base di tali risultati, il capitolo conclusivo offrirà infine spunti di riflessione per rilanciare il dibattito su quale sia il ruolo e la funzione del contratto collettivo, alla luce delle disposizioni contrattual-collettive esaminate nell’attuale contesto delle transizioni ecologica e sociale.

Abstract
