In 2016, the Italian legislator introduced, the d. l. n. 18/2016 which turned into law n. 49/2016, a new specific model of banking group – named Cooperative Banking Group – into the Italian legal framework (Text Banking). Therefore and taking into account the European Banking Union context, this thesis aims to verfy whether the “prevalent mutuality” of italian cooperative banks (BCCs) is still consistent with the current legal framework; indeed, by a combined reading of new and pre-existing rules, it emerges that in an “atomistic” point of view, these banks are, even now, distinguished by “prevalent mutuality”. Moreover, the dissertation below deems (in summary) that these cooperative banks (as affiliated institutions) and stock company (as central body) can coexist into new model: Cooperative Banking Group. Furthermore, the thesis states that the central body (S.p.A.) profit goals could even improve the development of these “prevalent mutuality” cooperative banks, which is the key feuture of italian local BCCs
