(1) Höffe's theory of political justice ("Politische Gerechtigkeit") is one of the few great and original models in recent political philosophy. Some main components of this theory are discussed in the paper: (2) Höffe's criterion for political justice, i.e. strong pareto-superiority over a state of nature / anarchy, (3) his justification of human rights by means of a comparison of its transcendental value with that of anarchy, (4) the introduction of a second, contractarian criterion of justice, (5) his legitimation of constitutional democracies, (6) and his plea for a rather minimal state which only guaranties human rights. Some of these ideas are criticized, e.g. that the transcendental value comparison from the perspective of liberties, instead of being neutral with respect to different conceptions of value, is biased in favour of a politically liberal position, and that Höffe's plea for a minimal state is not well founded. (7) On the other hand Höffe's view of an institutionalization and historicizing of moral norms is a real solution for problems of current political philosophy and ethics.
