The field of international investment is progressively growing, together with the incrementation of legal rules aimed at protecting the investment and the rights of the investor. However, in some cases these rights have to surrender to public goods of paramount importance, including cultural heritage of great significance for humanity. This contribution examines the main cases of conflict between protection of property of the investor and safeguarding of cultural heritage in the practice, with particular attention to the ICSID jurisprudence.
