With judgment no. 33 of 21 March 2025, the Italian Constitutional Court declared the partial unconstitutionality of Article 29-bis of Law no. 184 of 1983, insofar as it did not permit single persons residing in Italy to apply for a declaration of suitability for the international adoption of foreign minors. In doing so, the Court shifted the emphasis from the marital status of prospective parents to their practical capacity to provide the minor with a stable and harmonious family environment. This paper offers a critical reconstruction of the complex argumentative framework upon which the Court's ruling was built, subsequently proceeding to draft an inventory of the main and potential systemic repercussions that the decision is destined to produce within the regulation of adoptions.

Abstract
With judgment no. 33 of 21 March 2025, the Italian Constitutional Court declared the partial unconstitutionality of Article 29-bis of Law no. 184 of 1983, insofar as it did not permit single persons residing in Italy to apply for a declaration of suitability for the international adoption of foreign minors. In doing so, the Court shifted the emphasis from the marital status of prospective parents to their practical capacity to provide the minor with a stable and harmonious family environment. This paper offers a critical reconstruction of the complex argumentative framework upon which the Court's ruling was built, subsequently proceeding to draft an inventory of the main and potential systemic repercussions that the decision is destined to produce within the regulation of adoptions.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
