This special issue collects the outcomes of the PRIN 2022 research project "Looking for Legislative Intent: An Empirical Account," devoted to the role of the legislative intent argument in Italian case law. The volume opens with the presentation of the empirical research findings on the use of this argument in the case law of Italy's highest courts, followed by a series of contributions examining its relevance across different areas of law: criminal law interpretation, private law, civil and administrative case law, as well as the role of the reasonableness principle in defining the intentio legislatoris. Particular attention is devoted to the case law of the Constitutional Court, with in-depth analyses of the "end-of-life" issue and of the use of the argument in relation to the Twelfth transitional and final provision, as well as to the case law of the Council of State, with case studies concerning building regulations and access to administrative documents. Overall, the special issue offers an interdisciplinary, multi-sector survey of the weight, limits, and potential of the legislative intent argument as an interpretive tool used by Italian judges, highlighting both its persistent centrality and the theoretical and practical difficulties associated with its use.
Il fascicolo speciale raccoglie gli esiti del progetto di ricerca PRIN 2022 "Looking for Legislative Intent: An Empirical Account", dedicato al ruolo dell'argomento dell'intenzione del legislatore nella giurisprudenza italiana. Il volume si apre con la presentazione dei risultati della ricerca empirica condotta sull'uso di tale argomento nella giurisprudenza delle corti apicali italiane, cui segue una serie di contributi che ne esaminano la rilevanza in diversi ambiti del diritto: l'interpretazione penalistica, il diritto privato, la giurisprudenza civile e amministrativa, nonché il ruolo del principio di ragionevolezza nel definire l'intentio legislatoris. Particolare attenzione è dedicata alla giurisprudenza della Corte costituzionale, con approfondimenti sulla questione del "fine vita" e sull'uso dell'argomento in relazione alla XII disposizione transitoria e finale, nonché alla giurisprudenza del Consiglio di Stato, con casi di studio relativi all'edilizia e all'accesso ai documenti amministrativi. Nel complesso, il fascicolo offre una ricognizione interdisciplinare e multi-settoriale sul peso, i limiti e le potenzialità dell'argomento dell'intenzione del legislatore quale strumento argomentativo nell'attività interpretativa dei giudici italiani, evidenziando tanto la persistente centralità di tale argomento quanto le difficoltà teoriche e pratiche connesse al suo utilizzo
