I propose an examination of Nino Tamassia's thesis, contained in a book entitled 'Testamentum militis e diritto germanico'. Its basic premise relies on the absence of the idea of testamentary succession in the Barbarian populations. In the osmotic process of combination between Roman culture and barbaricum Tamassia finds elements of continuity between testamentum militis (where there would be a trace of pre-Roman Italic law) and the affirmation of the principle of testamentary succession which was applied by in thoose constellations of gentes who populated the territories beyond the Rhine and the Danube. In particular, my analysis focuses on investigation of the title 46 of Pactus legis Salicae (De adfathamire), in which Tamassia detects an analogy with the Roman 'fedecommesso'.

Abstract
